Shared ownership properties are homes that are purchased jointly with housing associations. It means that you pay rent on the equity share that the housing association retains in addition to any service charges and ground rent payable for that particular development. Most shared ownership leases contain a clause which enables the owner/occupier to increase their percentage share in the property at a later date.
Our residential conveyancing team regularly advise clients on purchasing property through the shared ownership scheme. The Right to Buy scheme allows tenants to buy their council property at a discounted rate. Our residential conveyancing team has experience of giving sensitive and straightforward advice in this area. We will explain the issues so you understand your entitlements, rights and responsibilities whilst liaising with the council’s solicitor to ensure that the transaction is completed with the minimum of disruption.
Islamic Finance (Shariah law)
The term 'islamic banking' refers to a system of banking or banking activity that is consistent with Islamic law (Shariah) principles and guided by Islamic economics. Sharia prohibts the fixed or floating payment or acceptance of specific interest or fees (known as riba or usury) for loans of money. Although these principles have been applied in varying degrees by historical Islamic economies due to lack of Islamic practice, only in the late 20th century were a number of Islamic banks formed to apply these principles within the muslim community.
We understand that Shariah home finance systems require a different approach. We can offer advice on; purchasing and selling (with or without Shariah Compliant Finance), refinancing and acquisition on residential property. Working with HSBC Amanah and the Islamic Bank of Britain, our Shariah Law specialist have handled over 250 Shariah conveyancing cases in the last 5 years and we are one of the largest law firms in the North to offer this service. Our experience means we can anticipate areas of difficulty at an early stage and advise you on the best possible solutions.
